The seesawing in the case of the South African asbestos mining claimants continued over several years. Then, in a July 2000 landmark decision, the British House of Lords Court of Appeals ruled that Cape plc could be sued in the British courts. A settlement was reached, but when Cape plc reneged on the first payment, claiming financial distress, the claimants' lawyers added the South African mining company Gencor, a spinoff of Cape, to the lawsuit. The case details Gencor's role in South African asbestos mining and its legal wrangling with the asbestos victims and their attorneys.
